Guantanamo Charges Dismissed

Two separate military judges dismissed charges against two defendants being tried, including Osama bin Laden's chaffeur, because they were not charged as "unlawful" enemy combatants, a designation set out by Congress as necessary to trial. The government prosecutors say they will appeal. Go ahead, say the judges. One problem. There's no appeals court in the system. I'm guessing that's probably because when setting up the tribunals, they never figured on a ruling in favor of the defendants.
