1) Voluntary Manslaughter

Date of Occurrence: 28 Feb 04. Reported by the 4ID on 28 Feb 04
Synopsis: Investigation revealed a PFC shot and killed a flexi-cuffed detainee while he was being detained in the vicinity of Kirkuk.
Status: Case closed. The Soldier was convicted at a General Court Martial and was found guilty of Voluntary Manslaughter. He was sentenced to three years in prison and received a Dishonorable Discharge.

2) Larceny/Aiding and Abetting the Enemy

Date of Occurrence: 22 Apr – 18 May 03. Reported by 3ID on 20 May 03.
Synopsis: Investigation revealed that several Soldiers, including a Captain and a Sergeant First Class, committed the following offenses at various locations in the vicinity of NE Baghdad: These offenses included theft of money and weapons from Iraqi citizens; providing or trading seized weapons to a member of the suspected Fedaheen; allowing unescorted access of an alleged Fedaheen member to a secure area; and consuming and/or accepting alcoholic beverages from Iraq citizens.
Status: Case closed. The soldiers court-martialed included a Captain and a Sergeant First Class. They were convicted of larceny and aiding and abetting the enemy at a General Court-Martial. The Captain was sentenced to 16 months in prison and dismissed from the Army. The Sergeant First Class pleaded guilty and was sentenced to 12 months in prison and reduced to E-1.
